These terms are between you and [LEGAL ENTITY NAME — fill in], registered at [REGISTERED ADDRESS — fill in] ("we", "us"). By creating an account or calling the API you accept them. If you are accepting on behalf of a company, you are saying you may bind it.
1. What the service does
Sendbu is an HTTP API for sending WhatsApp messages. You create an account and an organization, you mint API keys, you pair a WhatsApp number as a channel, and you POST messages to it. We queue each message and tell you what became of it with a signed webhook.
Not everything described is built. The API reference lists what runs today and what does not, and the home page draws the same line. Nothing on this site is a commitment to ship anything by any date.
2. The WhatsApp ban risk, which is yours
Sendbu connects to WhatsApp through an unofficial client. It is not the WhatsApp Business Platform and we are not a Meta business partner.
Meta may restrict, suspend or permanently ban any number connected this way, at any time, without warning or appeal. It may happen because of how you send, how much you send, what you send, who reports you, or for no reason you will ever be told. It can take the WhatsApp account itself, not just the API connection — including the account on the phone that number belongs to.
By using the service you accept that risk. Specifically:
- Do not connect a number you cannot afford to lose. A dedicated number, not a founder's personal one, is the sane choice.
- We cannot restore a banned number, appeal on your behalf, or tell you why it happened.
- Your use of WhatsApp is also subject to Meta's own terms, which are between you and them. We do not grant you any right to use WhatsApp.
- We may change or drop a connection method if it stops working or becomes untenable.
3. Acceptable use
This is a messaging product, so this section matters more than the rest of the page. You are responsible for every message sent with your keys.
Do not send unsolicited messages. Message only people who asked to hear from you, on the number they gave you, about the thing they gave it for. Bulk cold outreach, purchased lists, scraped numbers, and "they are technically a customer" blasts are all spam here.
You also may not use Sendbu to:
- Send anything unlawful, deceptive, harassing, hateful, or sexually exploitative.
- Impersonate a person or organization, run phishing or fraud, or distribute malware.
- Send messages that break the rules where your recipients live — consent, opt-out, timing and identification rules differ by country and are yours to know.
- Ignore an opt-out. If someone says stop, stop, and do it promptly.
- Resell raw access to the API as your own messaging service without telling us, or share keys outside your organization.
- Probe, overload or work around the service's limits, or use it to attack anyone else.
You must also keep your API keys and webhook secrets secret, and tell us promptly at [SECURITY CONTACT ADDRESS — fill in] if one leaks.
4. No SLA, and no billing today
There is no uptime commitment. No service level, no credits, no support response time. The service may be unavailable, may lose queued messages, and may be changed or taken down at short notice. Message delivery depends on WhatsApp, on your recipients' devices and on your own channel staying connected — none of which we control.
Nothing is charged today. There is no billing in the product and no payment method on file. If we introduce paid plans we will say what they cost and what they include before anyone is charged, and you will be able to stop using the service instead.
5. Your account and your content
You own your messages and your data. You grant us only what we need in order to run the service: to store, transmit and process them so the messages you ask us to send get sent.
You are responsible for your account, your members and their roles, and for having the right to message the people you message. We handle your data as described in the privacy policy.
6. Suspension and termination
You may stop at any time. Ask us to close your account and we will delete it, as the privacy policy describes — including its messages, keys and channels.
We may suspend an account when we believe it is breaking section 3, when it is putting the service or other customers at risk, or when the law requires it. Suspension stops the account's API keys from authenticating; it does not delete anything, and it is reversible. Where we can, we will tell you why and give you a chance to fix it. We may terminate an account that stays in breach, and we may discontinue the service entirely with reasonable notice.
7. Disclaimer and limitation of liability
The service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that it will be uninterrupted, secure, error-free, or that any message will be delivered.
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, nor for lost profits, lost revenue, lost data, or business interruption — including any loss arising from a WhatsApp number being restricted or banned.
Our total liability for all claims relating to the service is limited to the greater of the amount you paid us in the three months before the claim (which is currently zero, because nothing is charged) and [LIABILITY CAP — fill in a currency amount].
You will indemnify us against claims arising from the messages you send and from your breach of these terms.
Nothing here excludes liability that cannot lawfully be excluded.
8. Changes to these terms
We may update these terms. For a material change we will email the address on your account before it takes effect. Continuing to use the service afterwards means you accept the new version.
9. Governing law
